1. Acceptance of Terms

By accessing or using the Shutter Cloud platform, you agree to be bound by these Terms and Conditions, as well as all applicable laws and regulations. If you do not agree to these terms, you are prohibited from using or accessing the platform. The materials on this platform are protected by copyright and trademark laws.

2. Use License

You are granted temporary access to the materials on Shutter Cloud's platform for personal, non-commercial, and transitory viewing only. This constitutes a license, not a transfer of ownership. Under this license, you may not:

• Modify or copy the materials.
• Use the materials for any commercial purpose or public display (commercial or non-commercial).
• Attempt to decompile or reverse engineer any software on Shutter Cloud's platform.
• Remove any copyright or other proprietary notices from the materials.
• Transfer the materials to another person or "mirror" them on any other server.

This license will be automatically terminated if you violate any of these restrictions and may be revoked by Shutter Cloud at any time.

3. User Accounts

To access certain features of the platform, you may be required to register for an account. You must provide accurate and complete information and ensure that your account details remain up to date.

You are solely responsible for all activity that occurs under your account and must keep your password secure. If you become aware of any security breach or unauthorized use of your account, you must immediately notify Shutter Cloud.

4. Subscription and Payment Terms

Certain aspects of the Service may require payment. You must select a payment plan and provide accurate billing information, including your credit card or other payment method. You are responsible for promptly updating your account with any changes to your payment details.

By subscribing, you agree to pay Shutter Cloud in accordance with your selected plan and authorize Shutter Cloud to charge your payment method in advance on a recurring basis as per the agreed terms.

Your subscription will automatically renew at the end of your subscription period unless you cancel your subscription before the end of the current subscription period. You may cancel your subscription at any time, and cancellation will be effective at the end of the current billing cycle.

5. User Content

Our platform allows you to upload, store, and share content, including photographs and other materials. You retain all rights to your content. However, by using the platform, you grant Shutter Cloud a non-exclusive, worldwide, royalty-free license to use, copy, process, adapt, and publish your content solely for the purpose of providing and improving the platform.

You represent and warrant that:

• You own or have the necessary licenses, rights, consents, and permissions to use and authorize Shutter Cloud to use your content as required to exercise the licenses granted by you.
• Your content does not and will not infringe, violate, or misappropriate any third-party rights, including copyrights, trademarks, patents, trade secrets, moral rights, privacy rights, rights of publicity, or any other intellectual property or proprietary rights.
• Your content complies with all applicable laws and regulations.

6. Face Recognition Technology

Our Shutter Finder feature utilizes face recognition technology. By using this feature, you represent and warrant that you have obtained all necessary consents from individuals whose faces may be recognized.

You further agree to indemnify, defend, and hold harmless Shutter Cloud from any claims, liabilities, damages, or expenses arising from your use of this feature, including but not limited to claims related to privacy rights, data protection laws, or unauthorized use.

7. Disclaimer

The materials on Shutter Cloud's platform are provided "as is" and "as available." Shutter Cloud makes no warranties, express or implied, and expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement of intellectual property, or any other violation of rights.

Additionally, Shutter Cloud does not warrant or guarantee:

• The accuracy, completeness, or reliability of the materials on its platform.
• That the platform will be uninterrupted, error-free, or free from viruses or other harmful components.
• The results of using the platform or any materials contained within it.

Shutter Cloud is not responsible for any third-party content or external websites linked to its platform and does not endorse or make any representations about them.

8. Limitations

To the fullest extent permitted by law, Shutter Cloud and its suppliers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to:

• The use or inability to use the platform or its materials.
• Loss of data, revenue, or profits.
• Business interruption or any other commercial damages or losses.
• Unauthorized access to or alteration of your data.

This limitation applies even if Shutter Cloud or an authorized representative has been advised orally or in writing of the possibility of such damages.

9. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of India, without regard to its conflict of law principles. You irrevocably consent to the exclusive jurisdiction of the courts in Pune, Maharashtra, India, for any disputes arising from or relating to these terms.

10. Changes to Terms

Shutter Cloud reserves the right to update, modify, or revise these Terms and Conditions at any time without prior notice. Continued use of the platform after any changes constitutes your acceptance of the revised terms. It is your responsibility to review these terms periodically for updates.
